General terms and conditions of business

1. Conclusion of the contract

1.1. The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue.

1.2. By clicking the button “Order now at the stated price” you place a binding order for the goods contained in the shopping cart.

1.3. The confirmation of receipt of the order follows immediately after the order has been sent and does not yet represent acceptance of the contract. We may accept your order by sending an order confirmation by email or by delivering the goods.

1.4. In case of advance payment, the purchase contract is concluded upon confirmation of receipt of the advance payment by the seller.

 

2. Terms of purchase and delivery

Our terms and conditions of purchase and delivery apply to all online orders and are accepted with every order.

Orders and deliveries are only possible within Switzerland and Liechtenstein (except postal code 6911 Campione d'Italia). Orders can only be placed by persons aged 18 or over residing in Switzerland and Liechtenstein. Customers Under 18 years of age require the written consent of their legal guardian to place orders.

 

3. Shipping costs

For standard deliveries, shipping costs Chf 9.00.- (B-Post). For orders over CHF 100.-, the buyer will not be charged any shipping costs (as of January 1, 2024).
 

 

4. Offer and validity of prices

Our prices are final prices, are quoted in CHF and include VAT. They are valid at the time of ordering.

Price and special offers as well as customer discounts are only valid until revoked. All offers and promotions in advertising materials and in the online shop are only valid while stocks last. We ask for your understanding that the goods are only sold in household quantities. You will receive an electronic order confirmation from us. You cannot view orders in your customer account.

 

 

5. Returns

You can return goods that you do not like within 10 days of receipt, provided that they are complete and in an unused and undamaged condition.

The buyer is responsible for the costs of return shipment.

After expiry of the 10-day return period, we reserve the right to refund the goods together with a credit note in the form of a voucher from Warenweet .

To meet the deadline, it is sufficient to send the goods in good time without giving reasons to the following address:

Please have your return confirmed and keep this confirmation, because in case of a package loss, your return can only be credited upon presentation of this receipt.

If available, please always enclose a copy of the invoice or provide us with your complete customer details. This means we can quickly credit your returns.

The purchase price of the item(s) will be refunded to you immediately after receipt of the return to the bank or postal account number you provided.

 

6. payment

In principle, payment for your order can be made by credit card, debit card (EC card and postcard), Twint or advance payment . We reserve the right to only offer you certain payment methods for the requested delivery. Orders on account will no longer be possible from January 28, 2024 .

Installment payments can be arranged after prior agreement (only for regular customers).

 

6.1. Credit card

At Franceshina's fashion you can order online by credit card. To do this, simply select “Credit card” under “Payment method”. We accept Master Card, Visa, Diners Club and Discover. In addition to the card number, validity and credit card company, you will need the verification code of your credit card. The verification code is a three-digit number on your credit card that ensures payment security on online platforms.

 

6.2. Safe ordering thanks to extra protection

To increase your confidence in online shopping, we support Verified by VISA, MasterCard SecureCode and the Protect Buy process at Diners/Discover.

 

7. Warranty

Please check delivered items as soon as possible for obvious material or manufacturing defects, including transport damage, and report such defects immediately to us or the deliverer upon delivery.

 

Defects that could not be discovered during an appropriate inspection and only appear later must be reported immediately after they are discovered. If you fail to inspect the goods or to report the defect immediately, the goods will be deemed to have been approved and you will no longer be able to assert any claims against us.

Please report any defects or complaints by telephone, SMS or e-mail.

The purchase price of the item(s) will be refunded to you immediately after receipt of the return to the bank or postal account number you provided.

 

8. Retention of title/reminder

All delivered goods remain the property of Franceschina's fashion until full payment has been made.

In exceptional cases/with prior agreement, an order can be accepted on account. The invoice amount must generally be paid within 10 days of receipt of the goods, unless payment in installments has been agreed upon by mutual agreement (only in writing).

If the consumer defaults on payment, a reminder fee of CHF 10.00 will be charged per invoice.

 

9. Electronic communication

You agree that contract-related communications may be made in electronic form.

 

10. Printing and data errors

We assume no liability for any printing errors in our advertising materials or data errors in our online shop that are due to slight negligence. We are not liable for inadvertently incorrect pricing, errors in images, product descriptions or other texts such as voucher or promotional codes. Discount promotions or for delayed or non-delivery. If an article is not available due to a quality defect or insufficient stock, no liability will be accepted. Franceschina`s fashion will contact you immediately to offer you an alternative.

 

11. Contract language/storage of the order text

The contract is concluded in German. We do not save the order text and it can no longer be accessed after the order process has been completed. However, you can print out your order details immediately after submitting the order.

 

12. Alternative dispute resolution

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

  

13. Image rights

All image rights are owned by Franceshina's fashion and nails by Rachel or its partners. Use without express consent is not permitted.
